Visitation

The agreed upon plan for how you and your spouse will share time with your children is called visitation. The parent who has the children less than half the time has visitation with the children. Parents have the right to make their own visitation agreements if you both can agree. If you both do agree sign a visitation agreement, the court will find it binding and enforceable. Visitation orders may have many similarities, but each one is unique according to you, your spouse and your children. As always is the case, the child’s health, welfare and safety is the primary concern of a visitation plan.

Visitation According to a Schedule

It is always good to have a detailed visitation plan in place to prevent conflicts and confusion, and to make sure that everyone understands when and where visitation will take place, a visitation schedule detailing the times, dates and when the children will be spending their time with each parent. Visitation schedules may include vacations, holidays, birthdates, mother’s day, father’s day and other important family dates.

Reasonable Visitation

Sometimes there is a reasonable visitation order in place for everyone to follow. These orders are open-ended and allow the parents to work out a schedule between themselves. This works when the parents get along, are flexible and communicate well. However, if there are misunderstandings and disagreements, this “open-schedule” type of plan can be very disruptive for children.

Supervised Visitation

The courts will order this type of visitation when they are concerned for the child’s safety. The court may require that your spouse be supervised by you, another adult or oven a professional agency. Call our law offices to protect your rights if supervised visitation is even a remote possibility.

No Visitation

The courts will sometimes grant no visitation with the children if they are concerned for the physical or emotional well being of a child. When this is ordered the court is saying it is in the best interest of the child for the parent to have no contact with them.
